Terms of Service

1 Acceptance of Terms

By downloading, installing, or using the LumenVPN application or website at lumenvpn.net ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and LumenVPN.

2 The Service

LumenVPN provides a virtual private network ("VPN") service that encrypts your internet traffic and routes it through our servers to enhance your privacy and security online. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3 Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@lumenvpn.net if you suspect unauthorised access. You must be at least 13 years old (16 in the EEA) to create an account.

4 Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Distribute malware, spyware, or any malicious software
• Conduct unauthorised access to computer systems or networks (hacking)
• Send unsolicited bulk email (spam) or conduct phishing attacks
• Infringe on the intellectual property rights of any third party
• Transmit child sexual abuse material or any illegal content
• Engage in distributed denial-of-service (DDoS) attacks
• Circumvent, disable, or otherwise interfere with security features of the Service
• Resell or sublicense the Service without written authorisation from LumenVPN

Violation of this policy may result in immediate account termination and, where appropriate, referral to law enforcement authorities.

5 Subscriptions & Billing

LumenVPN offers a free tier with limited daily usage and paid subscription plans. Paid subscriptions are billed in advance on a recurring basis (monthly or annually). All fees are non-refundable except where required by applicable law or our refund policy.

You may cancel your subscription at any time through your account settings or the relevant app store. Cancellation takes effect at the end of the current billing period — you retain access until then. LumenVPN reserves the right to change pricing with at least 30 days' notice.

6 Intellectual Property

The LumenVPN name, logo, app, and all associated content are the intellectual property of LumenVPN and are protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our express written permission. Your use of the Service does not grant you any ownership rights.

7 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

LumenVPN does not warrant that use of the Service is lawful in your jurisdiction. You are solely responsible for determining whether your use complies with applicable laws.

8 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMENVPN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

9 Termination

We may suspend or terminate your account at any time if you breach these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may terminate your account at any time via the app (see our account deletion page). Termination does not entitle you to a refund except where required by law.

10 Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where LumenVPN is registered. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

11 Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and notify you via email or in-app notice for material changes. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
